Text and Email Messaging Terms & Conditions

Synapse Health and its affiliates, subsidiaries, agents, contractors, or vendors (“Synapse” or “we” or “us” or “our”) enables health care providers and individuals to order durable medical equipment or other necessary health care supplies. These Terms and Conditions apply when you opt-in to receive text messages or emails (collectively, “messaging”) for our Synapse Connect platform. Participation in our texting and email programs is optional. By opting in or participating in our programs, you accept and agree to these Terms and Conditions.

Text messaging and/or emails from us may include one time or recurring messages related to: (1) the Synapse Connect Platform, (2) the Synapse Connect Plus program, and/or (3) information regarding order status updates (collectively, the “Programs”). The frequency of messaging will vary depending on the recurring messaging program in which you enroll.
In all text messaging Programs, you may text “STOP” to opt out of the program at any time. In all email Programs, you may click on the “Unsubscribe” link to opt out of the program. Additionally, you can contact us directly at 1.888.33.MYDME to opt out of our text messaging Programs.

To participate in our texting Programs, you must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service.
In providing your phone number and enrolling in text messages, you are representing that you are: (i) the account holder for the mobile telephone number you provided when you opted-in to receiving text messages from Synapse; (ii) a resident of the United States; and (iii) the owner of and responsible for the mobile device you have enrolled. Providing your phone number and enrolling also confirms that you understand that Program text messages are facilitated and monitored by Twilio and Connect Plus, our third-party service providers, who sends and receives texts messages on our behalf.

To participate in our emailing Programs, you must have a valid email address, capable of two-way communication, and have an internet connection. In providing your email address and enrolling in the email messaging Program, you are representing that you are the account holder of the email address you provided.

With respect to your responses to Program messaging, any personal information contained in those responses will be used and disclosed subject to the terms of our Privacy Policy (https://www.synapsehealth.com/privacy-policy) as well as the Twilio Privacy Policy (https://www.twilio.com/legal/privacy) and in accordance with all applicable federal and state laws.

Messaging may include protected health information (“PHI”). To protect your PHI, we will follow federal and state privacy laws, including the Health Insurance Portability and Accountability Act and its regulations. As Synapse’s text messaging Programs are unencrypted, there is a risk that PHI could be intercepted or viewed by third parties, including others who access your device. To mitigate the risk that your confidential information is viewed by an unauthorized third party, we recommend password-protecting mobile device(s) and enabling text message encryption, if available.

Synapse is not liable for any unauthorized access or interception of messaging communications with us. By accepting these terms and conditions, you are assuming the risks of communicating confidential information, including PHI, through these methods, and consent to proceed with communicating in this manner despite these risks. If at any time you no longer want to accept these risks, you can opt out of the messaging Programs with immediate effect by following the opt out instructions listed above.

The Messaging Programs are offered on an AS IS, AS AVAILABLE basis. We do not guarantee the successful delivery of messaging by your wireless or internet provider. Messages sent by text may not be delivered if the mobile device is not in range of a transmission site, or if sufficient network capacity is not available at a particular time. Even within a coverage area, factors beyond the control of wireless carriers may interfere with message delivery, including the terrain, proximity to buildings, foliage, weather, and the recipient’s equipment. Messaging sent by email may not be delivered if the email provider’s server is malfunctioning or your internet connection is not sufficient at a particular time.

We will not be liable for losses or damages arising from (a) non-delivery, delayed delivery, or misdirected delivery of messaging; (b) inaccurate or incomplete content in a message; or (c) use or reliance on the content of any message for any purpose.
Under no circumstances will we be liable for any direct or indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with use of messaging whether or not we have been advised of the possibility of such damages.

In the event you change or deactivate your wireless telephone number or email address, you agree to promptly update your Synapse account information. We are not liable for any communication or transmission of confidential information, including PHI, by message which happens because you did not report that your mobile number or email address changed.
